Dr Clucas will discuss the For Women Scotland cases, situating them within recent gender critical case law and discourse and a broader context of resurgent prejudice.

In this talk, Dr Rob Clucas discusses the For Women Scotland cases, situating them within recent gender critical case law and discourse and a broader context of resurgent prejudice. Rob highlights the Supreme Court’s ill-informed and biologically reductionist approach and its implications for trans rights+. Rob argues that the judgment prioritises an external view of identities over experiential identification of the people most concerned, and thus the views that matter most are marginalised. Moreover, the judgment supports conservative (religious) populist anti-gender/ anti-feminist positions, legitimising a polarised and oversimplified ‘debate’. Rob argues that the current attacks on trans+ people threaten all minorities and erode the foundations of equality law.
